These Terms & Conditions set out the agreement between you (“the client”, "clients") and M&S Foto (“we”, “us”, or “our”) for the provision of photography services. By making a booking or using our services, you agree to the following terms.
1. Who we are

2. Booking and agreement
- A booking is confirmed once agreed in writing or through our booking system
- By confirming a booking, you agree to these Terms & Conditions
- The client is responsible for providing accurate booking details
- We reserve the right to decline bookings at our discretion
3. Pricing and payment
- Prices are agreed at the time of booking
- Payment terms (including any deposits, if applicable) will be confirmed in advance
- We reserve the right to update pricing at any time, but confirmed bookings will not be affected
- Full payment may be required before delivery of final images
4. Cancellations and rescheduling
- Standard sessions require at least 48 hours’ notice for cancellation or rescheduling
- Events, travel, or location-based bookings require at least 72 hours’ notice
We will always try to accommodate changes, but late cancellations may not be possible to reschedule.
We reserve the right to cancel or reschedule a booking in exceptional circumstances (e.g. illness, emergencies, or unforeseen events). In such cases, we will offer an alternative dates.
5. Our services
- We will provide photography services with reasonable skill, care, and professionalism
- The style of photography is based on our portfolio and creative approach
- As photography is a creative service, we cannot guarantee specific images, poses, or outcomes

The client agrees to:
- arrive on time for the session
- ensure access to agreed locations
- obtain any necessary permissions (e.g. venue, property, or event permissions)
- ensure a safe working environment
We are not responsible for delays, restrictions, or issues caused by third parties or circumstances outside our control.
7. Delivery of images
- Images will be delivered within a reasonable timeframe, typically indicated on the relevant booking page and communicated during the session
- Enhanced Photos of Your Choice are images you select for additional detailed editing, where we carefully refine each photo and remove minor imperfections from both the subject and the surrounding area where appropriate. Typically you have 7 days to choose your selected images
- The final images are edited at our discretion
- Raw (unedited) images are not provided unless agreed in advance
- Delivered images represent our final artistic work
8. Copyright and usage
- All images remain the copyright of M&S Foto
- Usage rights are granted according to the booking and the agreed intended use of the images
- For business, brand, product, or other commercial bookings, usage rights will be agreed as part of the booking and may include website, marketing, advertising, social media, or other business use as specified
- For private bookings, images are licensed for personal, non-commercial use, including sharing with family and on personal social media.
- Images must not be sold, licensed to third parties, or used outside the agreed scope without prior permission
9. Portfolio and promotional use
We may request permission to use selected images for:
- our website
- portfolio
- social media
- marketing materials
Where consent is required, images will only be used with your written agreement.
10. Limitation of liability
- We are not liable for circumstances beyond our control, including but not limited to weather conditions, venue restrictions, equipment failure despite reasonable precautions, or unforeseen events
- In the unlikely event that we are unable to deliver the agreed services, our liability will be limited to the total amount paid

We process personal data in accordance with our Privacy Policy, available on our website.
12. Changes to bookings or services
We reserve the right to make reasonable changes to services where necessary. Any significant changes will be communicated as soon as possible.
13. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
